Terms and conditions
These General Booking Terms and Conditions (hereinafter, the General Terms and Conditions) shall govern the commercial relationship arising between CAS MIOT SL and the user or customer in connection with bookings made through the forms made available by CAS MIOT SL on www.hotelmonport.com.
Making a reservation through the websites of CAS MIOT SL implies the express acceptance by the customer or user of these terms and conditions, as well as the terms of use established for browsing the websites owned by CAS MIOT SL.
These terms and conditions shall apply without prejudice to the application of any legal provisions applicable to each specific case.
CAS MIOT SL reserves the right to make any changes it considers appropriate to these General Terms and Conditions without prior notice. Such changes may be made through its websites by any means permitted by law and shall be binding for as long as they remain published on the website and until they are validly replaced by subsequent terms and conditions. However, CAS MIOT SL reserves the right, where it considers appropriate, to apply specific terms and conditions of contract in preference to these General Terms and Conditions, provided they are announced in due time and form.
Information prior to booking
CAS MIOT SL informs users that the booking procedure through its websites is detailed in the corresponding section for completing a reservation.
Likewise, CAS MIOT SL informs users that they may access the terms of use available on the same website.
By making a reservation with CAS MIOT SL through its website, the user or customer expressly declares that they know, understand and accept these terms of use and the General Terms and Conditions. Likewise, the user declares that they are of legal age and have the legal capacity and capacity to act necessary to access the websites of CAS MIOT SL and enter into contracts through them. The user is responsible for keeping the username and password obtained upon registration as a customer confidential and for using them responsibly, and may not transfer them to any other person.
Once the reservation has been made, the user will see the booking confirmation on screen and may print it as proof of the reservation made.
The booking confirmation and proof of booking printed by the user shall not be valid as an invoice.
Booking procedure
Booking offers and price reference
In compliance with current regulations and, in particular, Law 34/2002 on Information Society Services and Electronic Commerce, CAS MIOT SL provides, in the relevant section for completing a reservation, information on all available booking options, their characteristics and their prices. However, CAS MIOT SL reserves the right to withdraw, replace or modify the offers made available to its customers through its website by simply changing their content. Accordingly, the products and/or services offered at any time through the CAS MIOT SL website shall be governed by the General Terms and Conditions in force at that time. Likewise, the company may cease to offer access to the aforementioned products and/or services at any time and without prior notice.
Price information
Each booking option offered shall indicate its price and whether VAT or any other applicable tax is included. The prices displayed on screen shall be those in force at any given time, except in the event of a typographical error. Where the price differs for the reason stated above, CAS MIOT SL shall notify the customer by email before charging for the reservation.
Availability
The availability of offers provided by CAS MIOT SL through its website may vary depending on customer demand. Although CAS MIOT SL updates its database periodically, the reservation requested by the customer may be unavailable at that time. In such case, CAS MIOT SL shall send the customer an email informing them that the offer is unavailable.
Payment methods
For reservations made through its website, CAS MIOT SL requests the details of a credit card held by the person making the reservation in order to guarantee its validity. Please note that the establishment does not charge your credit card when the reservation is made. The card is used solely as a guarantee. The establishment reserves the right to verify the validity of the credit card prior to the customer's arrival. The invoice corresponding to the reservation shall be settled directly at the establishment, whether in cash, by credit card or by any other method accepted by the establishment.
Cancellation of the reservation
If the cancellation is made more than 24 hours in advance, the establishment will not make any charge. If the cancellation is made less than 24 hours in advance, the establishment may charge part of the total amount payable to the credit card number provided.
Right of withdrawal
In accordance with Article 103 of Law 3/2014 of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users, the supply of services or goods made to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from the right of withdrawal.
Applicable law and jurisdiction
CAS MIOT SL also reserves the right to bring any civil or criminal actions it considers appropriate for the improper use of its website and content or for failure to comply with these terms and conditions.
The relationship between the user and the service provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their disputes to arbitration or resort to the ordinary courts, in compliance with the applicable rules on jurisdiction and competence. CAS MIOT SL is domiciled in the BALEARIC ISLANDS, Spain.
